    Terms & Conditions of Use

    Clear Terms. Professional Ownership.

    These Terms & Conditions govern your use of FlyHSD.com, creation and use of an HSD customer account, purchases from HSD North America, and other interactions with our products, services and website.

    Effective Date: September 1, 2026
    Purchases Orders are subject to availability, verification, payment approval and HSD acceptance.
    Safe Operation Pilots are responsible for assembly, setup, airworthiness and safe operation.
    Separate Policies Warranty, shipping, privacy and returns are governed by their respective HSD policies.
    California Based HSD North America is a California-based business.

    Please read these Terms & Conditions carefully before using FlyHSD.com or placing an order.

    By accessing or using FlyHSD.com, creating an account, placing an order, or otherwise using HSD North America services, you agree to these Terms and to the policies incorporated into them by reference.

    If you do not agree with these Terms, you should not use FlyHSD.com or place an order through the website.

    1. Acceptance of Terms

    These Terms & Conditions constitute an agreement between you and HSD North America concerning your use of FlyHSD.com and purchases or services provided through HSD North America.

    Additional terms may apply to particular products, promotions, programs, events, services or transactions. Where additional terms are clearly disclosed, those terms form part of the applicable transaction.

    HSD's Privacy Notice, Shipping & Delivery Policy, Limited Warranty Policy, and Returns & Refunds Policy are incorporated into these Terms by reference where applicable.

    2. Eligibility & Legal Capacity

    By placing an order or entering into a transaction with HSD, you represent that you have the legal capacity to enter into the transaction or are acting with authorization from a person or organization that does.

    Certain HSD products are advanced hobby products and may require specialized knowledge, equipment, training, certifications, memberships or operating privileges.

    The ability to purchase a product does not represent that HSD has determined that the purchaser is qualified to assemble, operate or fly that product.

    3. Customer Accounts

    Customers may create an account on FlyHSD.com where account functionality is available.

    Customers are responsible for maintaining the confidentiality of account credentials and for activity occurring through their account.

    Account information should be accurate and kept reasonably current.

    Contact HSD promptly if you believe an account has been accessed without authorization.

    HSD may suspend or restrict account access when reasonably necessary to protect the customer, HSD, payment systems, or other users from suspected fraud, misuse or security threats.

    4. Product Information

    HSD strives to provide accurate product descriptions, specifications, photographs, compatibility information, availability and pricing.

    RC products may be updated or revised during their production life. Manufacturers may make reasonable running changes to components, electronics, packaging, hardware, finishes, specifications or other product details.

    Product photographs may show optional equipment, accessories, batteries, radio systems, demonstration equipment, prototypes, alternate finishes or other items that are not included unless specifically stated in the applicable product listing.

    Colors and appearance displayed electronically may vary somewhat depending on lighting, photography, display settings and normal production variation.

    5. Pricing, Errors & Availability

    Prices and product availability are subject to change without notice before an order is accepted.

    HSD makes reasonable efforts to maintain accurate website information but errors may occasionally occur involving:

    • Pricing
    • Specifications
    • Inventory
    • Shipping calculations
    • Promotional discounts
    • Product descriptions
    • Compatibility information

    If a material error is discovered before fulfillment, HSD may correct the error, contact the customer for instructions, or cancel the affected transaction and refund applicable amounts paid for merchandise not provided.

    HSD is not obligated to fulfill an order based on an obvious pricing, inventory or technical error.

    6. Orders & Order Acceptance

    Submitting an order through FlyHSD.com constitutes an offer to purchase the products identified in the order.

    Receipt of an automated order confirmation does not necessarily constitute final acceptance of the order.

    Orders may be subject to:

    • Inventory availability
    • Payment authorization
    • Fraud or security review
    • Address verification
    • Shipping eligibility
    • Export or regulatory requirements
    • Product restrictions
    • Other reasonable transaction review

    HSD may accept, decline or cancel an order before fulfillment when reasonably necessary and permitted by applicable law.

    7. Payment

    Customers agree to provide valid payment information and authorize HSD and its payment providers to process applicable charges associated with the transaction.

    Payment authorization may occur before shipment.

    HSD may delay or cancel fulfillment if:

    • Payment cannot be authorized
    • The transaction is declined
    • Payment information cannot be verified
    • The transaction presents a reasonable fraud concern
    • A payment dispute exists concerning the transaction

    8. Fraud Prevention & Order Verification

    High-value RC aircraft and related equipment may present elevated fraud and payment risk.

    HSD may use reasonable fraud-prevention and order-verification procedures before accepting or fulfilling an order.

    HSD may request additional information reasonably necessary to verify:

    • Purchaser identity
    • Payment authorization
    • Billing information
    • Shipping information
    • Order legitimacy

    Failure to provide reasonably requested verification information may result in delay or cancellation of the order.

    9. Order Changes & Cancellations

    Order changes and cancellations are not guaranteed after an order has been submitted.

    Once an order enters warehouse fulfillment, carrier processing, specialized freight preparation or shipment, HSD may be unable to stop or modify it.

    Customer-requested cancellations, refused deliveries and convenience returns are governed by the HSD North America Returns & Refunds Policy.

    HSD may cancel an order where necessary because of payment problems, inventory errors, fraud concerns, pricing errors, shipping restrictions, safety concerns or another legitimate business reason.

    10. Shipping & Delivery

    All shipment preparation, shipping charges, carrier selection, high-value shipping protection, delivery procedures, damage claims and lost-shipment procedures are governed by the HSD North America Shipping & Delivery Policy.

    HSD reserves the right to select or substitute the carrier, service level, routing or transportation method reasonably appropriate for the size, value, contents and destination of the shipment.

    Carrier delivery estimates are not guaranteed by HSD.

    11. Returns & Refunds

    Customer-requested returns, exchanges, cancellations, refused deliveries, abandoned pickup orders, final-sale merchandise, restocking charges and refund procedures are governed by the HSD North America Returns & Refunds Policy.

    Products that have been assembled, modified, painted, flown, damaged or otherwise used may have limited or no eligibility for a convenience return, subject to the Returns & Refunds Policy and applicable law.

    Warranty claims and shipping-damage claims are separate from ordinary convenience returns.

    12. Limited Warranty

    Eligible HSD products are covered according to the HSD North America Limited Warranty Policy.

    Warranty coverage applies to qualifying manufacturing defects and does not constitute insurance against crashes, hard landings, pilot error, improper setup, misuse, unsuitable operating surfaces, modifications, normal wear or other excluded conditions.

    The applicable Limited Warranty Policy governs warranty period, eligibility, exclusions, claim procedures, remedies and warranty-evaluation returns.

    13. Product Inspection & Airworthiness

    RC aircraft are complex products that require inspection, assembly, setup and maintenance by the purchaser or operator.

    Customers should inspect products promptly upon delivery and, where practical, verify mechanical and electronic functions before permanent assembly, modification or operation.

    Before every flight, the pilot is responsible for determining that the aircraft is airworthy.

    This includes appropriate inspection and verification of items such as:

    • Airframe condition
    • Structural attachments
    • Control surfaces
    • Linkages
    • Servos
    • Control direction
    • Radio programming
    • Receiver operation
    • Failsafe configuration where applicable
    • Center of gravity
    • Battery condition and retention
    • Power-system condition
    • Landing gear
    • Fasteners and hardware

    14. RC Aircraft Safety & Assumption of Risk

    Radio-controlled aircraft are not toys and may cause serious injury, property damage, fire or other harm if assembled, maintained or operated improperly.

    Aircraft may contain:

    • High-speed rotating components
    • High-current electrical systems
    • Lithium polymer batteries
    • High-performance propulsion systems
    • Retractable landing gear
    • Gas turbine engines
    • Other components capable of causing injury or damage
    The pilot is responsible for safe operation. Operation of RC aircraft involves inherent risks. Users are responsible for selecting an appropriate flying location, maintaining adequate separation from people and property, following applicable rules, and operating within their own experience and ability.

    15. Turbine & High-Performance Aircraft

    HSD turbine-powered and other high-performance aircraft are intended for experienced operators with the knowledge and skill necessary to safely assemble, inspect, maintain and operate them.

    Turbine operators are responsible for complying with all applicable:

    • Federal aviation requirements
    • State and local requirements
    • Flying-site rules
    • Club requirements
    • Insurance requirements
    • AMA requirements when operating under AMA rules
    • Turbine waiver requirements when applicable
    • Fire and safety requirements
    • HSD product instructions and operating limitations

    HSD's sale of a turbine aircraft does not represent certification that the purchaser possesses the qualifications required to operate it.

    16. Landing Surfaces & Intended Operation

    Aircraft must be operated from surfaces reasonably appropriate for the design and intended use of the aircraft and landing gear.

    Unless product-specific documentation expressly states otherwise, HSD scale landing gear systems are intended for operation from smooth, maintained paved surfaces.

    Grass, artificial fabric surfaces, geotextile surfaces, gravel, dirt, uneven pavement, cracks, holes and rough or irregular surfaces can create substantially greater loads on scale landing gear systems.

    Operation from an unsuitable surface may result in landing gear, retract, wheel, brake, steering, gear-door or airframe damage and may affect warranty eligibility as described in the HSD Limited Warranty Policy.

    Where a particular HSD aircraft is specifically designed or approved for operation from grass or another surface, the product-specific instructions for that aircraft control.

    17. Modifications & Aftermarket Equipment

    Owners may choose to install aftermarket radios, receivers, electronics, batteries, accessories or other equipment.

    Customers are responsible for determining compatibility and ensuring proper installation, programming and operation.

    Installation of aftermarket equipment does not automatically eliminate all HSD warranty coverage, but HSD is not responsible for failures caused or materially contributed to by:

    • Incompatible equipment
    • Improper installation
    • Improper programming
    • Modified wiring
    • Incorrect voltage
    • Structural modification
    • Power-system changes
    • Other non-factory modifications

    18. Open-Box, Used, Demonstration & Special-Condition Products

    Certain products may be specifically offered as:

    • Open Box
    • Damaged Box
    • Used
    • Preowned
    • Demonstration
    • Refurbished
    • Clearance As-Is
    • Final Sale

    These products may have different cosmetic condition, completeness, return eligibility, warranty coverage or other terms.

    Any special condition or limitation disclosed on the product page at the time of purchase forms part of the transaction.

    A normal promotional discount on a new product does not by itself convert that product into an "as-is" item or eliminate applicable warranty rights.

    19. Product Resale & Warranty Transfer

    HSD products may be resold by their owners subject to applicable law.

    However, resale of a product does not automatically transfer HSD warranty rights.

    Warranty eligibility is governed by the HSD Limited Warranty Policy and generally applies to the original retail purchaser unless HSD approves otherwise in writing.

    20. Intellectual Property

    FlyHSD.com and its content may contain trademarks, logos, product names, graphics, photographs, videos, designs, text, software, documentation and other materials owned by or licensed to HSD or its partners.

    Except where expressly authorized, users may not:

    • Copy or reproduce protected website content
    • Use HSD trademarks in a misleading manner
    • Represent themselves as HSD or an Authorized HSD Dealer
    • Modify or distribute HSD materials for commercial use
    • Remove copyright, trademark or ownership notices
    • Use HSD content to create misleading or counterfeit products

    Nothing in these Terms transfers ownership of HSD intellectual property to the website user or purchaser.

    21. Reviews, Photos & User-Submitted Content

    Where FlyHSD.com permits reviews, photographs, comments or other user-submitted content, users are responsible for the content they submit.

    Submitted content must not:

    • Contain unlawful material
    • Infringe another person's intellectual-property rights
    • Contain malicious software or harmful code
    • Impersonate another person or entity
    • Contain knowingly false or fraudulent claims
    • Violate another person's privacy rights

    HSD may moderate, remove or decline to publish user-submitted content where reasonably appropriate.

    22. Prohibited Uses

    FlyHSD.com and HSD services may not be used to:

    • Commit fraud
    • Submit false warranty or shipping claims
    • Use stolen or unauthorized payment information
    • Attempt unauthorized access to systems or accounts
    • Interfere with website operation or security
    • Introduce malware or malicious code
    • Harvest customer or website information unlawfully
    • Misrepresent affiliation with HSD
    • Engage in unlawful activity
    • Circumvent reasonable account or transaction restrictions

    23. Third-Party Services & Links

    FlyHSD.com may contain links, embedded content or integrations involving independent third parties such as:

    • Payment providers
    • Shipping carriers
    • Video platforms
    • Social-media platforms
    • Manufacturers
    • Dealers
    • Other external services

    HSD is not responsible for the independent terms, privacy practices, availability or content of third-party websites or services.

    24. Website Availability

    HSD seeks to maintain reliable access to FlyHSD.com but does not guarantee that the website will always be uninterrupted, error-free or continuously available.

    Website availability may be affected by:

    • Maintenance
    • Software updates
    • Hosting interruptions
    • Network outages
    • Security incidents
    • Third-party service interruptions
    • Other technical circumstances

    25. Website Information Disclaimer

    FlyHSD.com and its informational content are provided for general product, sales and support purposes.

    HSD makes reasonable efforts to provide accurate information, but website materials may occasionally contain errors, omissions or outdated information.

    Product-specific manuals, safety instructions, technical bulletins and current HSD support guidance should be followed where they provide more specific instructions.

    26. Limitation of Liability

    To the fullest extent permitted by applicable law, HSD North America shall not be liable for indirect, incidental, consequential, special or punitive damages arising from use of FlyHSD.com, an HSD product, or an HSD service.

    This may include, where permitted by law:

    • Loss of use
    • Loss of profits
    • Loss of business opportunities
    • Travel expenses
    • Competition expenses
    • Event expenses
    • Loss or damage to other equipment
    • Other consequential losses

    Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited.

    Product-specific warranty remedies are governed by the HSD Limited Warranty Policy.

    27. Customer Responsibility

    Customers are responsible for losses, damage or claims resulting from their own unlawful conduct, fraud, intentional misuse, unauthorized modification, or violation of these Terms to the extent permitted by applicable law.

    Nothing in this section is intended to alter rights or responsibilities that cannot legally be waived.

    28. Events Beyond Reasonable Control

    HSD will not be responsible for delay or failure caused by circumstances beyond its reasonable control, including:

    • Severe weather
    • Natural disasters
    • Fire
    • War or civil disturbance
    • Government action
    • Transportation disruption
    • Labor interruption
    • Utility or communications failure
    • Carrier disruption
    • Supply-chain interruption
    • Cybersecurity incidents
    • Other extraordinary events outside HSD's reasonable control

    HSD will make reasonable efforts to resume affected operations when practical.

    29. Right to Refuse Service or Cancel Transactions

    HSD reserves the right, to the extent permitted by law, to refuse service, restrict account access, cancel orders or decline future transactions where reasonably necessary to address:

    • Suspected fraud
    • Payment risk
    • Chargeback abuse
    • False warranty or shipping claims
    • Threats toward employees or representatives
    • Harassment or abusive conduct
    • Unlawful activity
    • Safety concerns
    • Attempts to circumvent prior account restrictions
    • Inventory or pricing errors
    • Other legitimate business or security concerns

    If HSD cancels an unfulfilled order, amounts paid for merchandise not provided will be refunded except for amounts or costs legitimately nonrefundable under these Terms, another applicable HSD policy, or applicable law.

    30. Privacy

    HSD's collection, use, disclosure and protection of personal information are described in the HSD North America Privacy Notice.

    31. Electronic Communications

    When you use FlyHSD.com, place an order or communicate electronically with HSD, you consent to receive transaction and service communications electronically where permitted by law.

    Electronic communications may include:

    • Order confirmations
    • Invoices
    • Shipping notices
    • Warranty communications
    • Support responses
    • Policy notices
    • Other transaction-related communications

    Marketing communications are handled separately in accordance with applicable law and the HSD Privacy Notice.

    32. Governing Law

    HSD North America is based in California.

    To the extent permitted by applicable law, these Terms and transactions with HSD North America are governed by the laws of the State of California, without regard to conflict-of-law principles.

    Nothing in this section is intended to deprive a consumer of mandatory protections provided by law that cannot legally be waived.

    33. Dispute Resolution

    HSD encourages customers to contact HSD Support before initiating a formal dispute so that the parties have an opportunity to resolve the matter efficiently and professionally.

    Nothing in these Terms prevents either party from exercising rights or remedies available under applicable law.

    These Terms do not currently require mandatory arbitration. Any future arbitration or similar dispute-resolution provision would require an update to these Terms and would apply only as permitted by applicable law.

    34. Severability

    If any provision of these Terms is found unenforceable or invalid under applicable law, that provision will be interpreted or limited to the extent necessary to make it enforceable where permitted.

    The remaining provisions will continue in effect to the extent permitted by law.

    35. No Waiver

    HSD's decision not to enforce a provision of these Terms in a particular situation does not waive HSD's right to enforce that provision in another situation.

    Providing goodwill assistance or making an exception for one customer does not establish a continuing obligation or modify these Terms for other transactions.

    36. Changes to These Terms

    HSD North America may update these Terms from time to time to reflect changes in:

    • Business practices
    • Products or services
    • Website functionality
    • Carrier or fulfillment practices
    • Technology
    • Applicable law
    • Other operational requirements

    The effective date displayed at the top of this page identifies the current version.

    Unless otherwise required by applicable law, changes will apply prospectively and will not retroactively reduce rights already provided under an accepted transaction.
