    9. California Online Tracking Disclosure

    Traditional "Do Not Track" Signals

Some web browsers offer a traditional "Do Not Track" or "DNT" setting intended to signal a user's preference regarding online tracking.

Because there is not a single universally accepted industry standard governing traditional DNT signals, FlyHSD.com does not treat a traditional DNT browser signal by itself as a universal instruction governing all website data processing.

Global Privacy Control and Other Opt-Out Preference Signals

Global Privacy Control ("GPC") and other legally recognized opt-out preference signals are different from traditional DNT signals.

Where California law requires HSD to recognize an applicable opt-out preference signal, HSD will honor supported legally valid signals in accordance with applicable law and the technologies used by FlyHSD.com.

    Third-Party Tracking

Third-party analytics, advertising, ecommerce, security or technology providers may collect information about a user's interaction with FlyHSD.com through cookies, pixels or similar technologies.

Depending on the provider and technologies in use, these parties may collect information about online activities over time and across different websites or online services.

    10. Analytics, Advertising & Marketing

HSD may use analytics, advertising and marketing technologies to understand website activity, measure advertising effectiveness, improve FlyHSD.com and communicate with customers interested in HSD products.

Depending on the technology involved, advertising or analytics providers may receive information such as:

    • Cookie or device identifiers
    • IP address
    • Browser information
    • Internet activity
    • Products viewed
    • Advertising interactions
    • Referral information

HSD does not operate as a data broker and does not sell customer lists for monetary consideration.

California privacy law can define certain advertising-related disclosures as a "sale" or "sharing" even when no money is exchanged. If applicable California law requires HSD to provide an opt-out from such activity, HSD will provide and honor the required privacy choice.

    11. Who May Receive Personal Information

HSD may disclose personal information to categories of recipients reasonably necessary to operate our business, including:

    Business Transactions

Information may be transferred as part of a merger, acquisition, financing, restructuring, sale of assets or other legitimate business transaction, subject to applicable law.

    12. Data Retention

HSD retains personal information for only as long as reasonably necessary for the purposes described in this notice or as required or permitted by applicable law.

    Retention periods may depend on:

    • The type of information
    • The purpose for which it was collected
    • The customer relationship
    • Warranty and product-support needs
    • Accounting and tax requirements
    • Fraud-prevention requirements
    • Payment disputes and chargeback periods
    • Product-safety considerations
    • Legal obligations
    • Applicable statutes of limitation

Order, transaction, warranty, shipping-claim and support records may be retained longer than ordinary website-activity data because they may be necessary for accounting, technical support, warranty administration, fraud prevention or legal obligations.

    13. California Privacy Rights

California privacy laws may provide California residents with certain rights regarding personal information.

The specific rights available depend on the law applicable to HSD, the nature of the information involved and the circumstances of the processing.

Where required by applicable California law, eligible rights may include the right to:

    • Know whether HSD collects or processes personal information about you
    • Request information about categories and specific pieces of personal information collected
    • Request correction of inaccurate personal information
    • Request deletion of personal information, subject to legal exceptions

    • Limit certain uses or disclosures of sensitive personal information when applicable
    • Opt out of certain legally covered automated processing where applicable
    • Receive equal service and pricing without unlawful discrimination for exercising a privacy right

These rights apply where required by law. Nothing in this Privacy Notice is intended to represent that HSD is subject to a particular California privacy statute unless that law applies to HSD.

    14. Sale, Sharing & Targeted Advertising

HSD does not sell customer lists for monetary consideration.

Some California privacy laws use broader definitions of "sale" or "sharing" that may include certain disclosures of identifiers or online activity to advertising technology providers for cross-context behavioral advertising.

If HSD engages in activity that gives consumers a legal right to opt out of sale or sharing, HSD will provide an appropriate opt-out method and honor eligible opt-out requests as required by applicable law.

Where legally required, HSD will also process supported opt-out preference signals such as Global Privacy Control.

    15. California Direct Marketing Disclosure

California Civil Code Section 1798.83 may provide certain California customers with the right to request information regarding specified disclosures of personal information to third parties for those third parties' own direct marketing purposes.

If this law applies to HSD and you wish to make such a request, submit a written privacy request to HSD and identify the request as a:

    California Direct Marketing Privacy Request

HSD will respond to eligible requests as required by applicable law.

    16. How to Submit a Privacy Request

To submit a privacy request, visit:

    FlyHSD.com/hsd-support

Clearly identify your request as a Privacy Request and describe the right you wish to exercise.

HSD may need to verify your identity before completing certain requests. Verification may include matching information associated with your customer account, order history or previous interaction with HSD.

HSD will request only information reasonably necessary to verify and process the request.

Certain information may be retained where necessary to complete transactions, preserve warranty records, comply with legal requirements, prevent fraud, maintain security, resolve disputes or exercise legal rights.

If applicable law requires HSD to provide additional methods for submitting privacy requests, those methods will also be made available.

    17. Authorized Privacy Agents

Where permitted by California law, you may authorize another person or entity to submit an eligible privacy request on your behalf.

HSD may require documentation showing that the agent has authority to act for you and may verify your identity directly unless applicable law provides otherwise.

    18. Appeals

If applicable privacy law provides a right to appeal HSD's decision regarding a privacy request, instructions for submitting an appeal will be provided with the applicable response or may be requested through HSD Support.

    19. Information Security

HSD uses reasonable administrative, technical and organizational safeguards designed to protect personal information from unauthorized access, disclosure, alteration, misuse or loss.

Access to personal information is intended to be limited to employees, contractors and service providers who reasonably require the information to perform authorized business functions.

No information system can guarantee absolute security. Although HSD uses reasonable safeguards, no website, network, electronic transmission or storage system can be guaranteed to be completely secure.

    20. Marketing Communications

HSD may send product news, promotions, event information, aircraft announcements and other marketing communications where permitted by law.

You may unsubscribe from promotional email by using the unsubscribe link included in the message or by contacting HSD.

Opting out of promotional communications does not prevent HSD from sending necessary transactional or service-related communications, including:

    • Warranty communications
    • Customer-support responses
    • Product-safety information

FlyHSD.com is a general-audience ecommerce website and is not directed to children under 13.

HSD does not knowingly collect personal information online from children under 13 in circumstances requiring parental consent.

Where applicable California law imposes additional requirements concerning the sale or sharing of personal information belonging to consumers under 16, HSD will comply with those requirements.

If you believe a child has improperly submitted personal information to HSD, please contact HSD Support.

FlyHSD.com may contain links, embedded content or integrations involving third-party websites, payment providers, videos, social-media platforms or other services.
